Letter to Members of the European Parliament · 22 March 2000

Overview: Letter addressed “to all Members of the European Parliament”: Mr Collorafi forwards to them the judgment of the Paris Court of Appeal of 8 March 2000 as an illustration of abuses of a dominant position and of economic dependence.

Key points

Mr Collorafi encloses the judgment of 8 March 2000 concerning him, in which he sees a “dramatic” illustration of the situation of businesses subject to abuse of a dominant position and economic dependence when the contracts in dispute are applied in bad faith. He describes the collapse caused by the abrupt termination of contractual relationships and hopes that the European Parliament will take up the matter in order to put an end to these practices.

Significance

A letter of political mobilisation: Mr Collorafi seeks to take his case into the European legislative arena, at the time of the debates on economic regulation.

Bernard COLLORAFI 21 B Chemin de l'Estelle 06 110 LE CANNET Tel and fax 04 93 45 99 15 e-mail : abcollo@yahoo.fr To all Members of the European Parliament Madam, Sir, Globalisation, abuse of a dominant position, economic dependence, the moralisation of commercial practices are everyday terms. Please find enclosed the Judgment delivered by the Paris Court of Appeal on 8 March 2000 concerning me. It perfectly illustrates the dramatic situation of businesses finding themselves in a situation of abuse of a dominant position and economic dependence, notably when the contracts are disputed and their application is in bad faith. The brutal and abusive terminations of contractual relations lead them to complete collapse, while the dominant parties play with the professional future (and indeed the very life) of their ultimately ruined managers. I hope that you will make good use of it in the European Parliament or in your country so that these practices, whose perpetrators think only of their personal enrichment in disregard of the law, cease for good.
